The statute of limitations for claims of medical negligence varies by jurisdiction; in some, it is 2 years, while in others, it may be up to 6 years. The length of time a patient has to file a claim depends on the legislation of the particular jurisdiction where the claim is to be made.
The statute of limitations refers to the time restriction within which a claim must be filed, which may vary depending on the circumstances. Neurosurgeon Dr. Christopher Duntsch, also known as “Dr. Death,” worked in Texas and was proven responsible for numerous patients’ deaths and severe injuries. He performed 38 operations on patients over two years, leaving many with irreversible nerve damage, ongoing pain, paralysis, and even death.
He was charged with performing superfluous procedures and operating on improper body areas since his surgical abilities were judged to be far from excellent. Before two of his colleagues filed a complaint, the Texas Medical Board disregarded multiple accusations against him. Only then did the board take action.
Many allegations of medical malpractice, including five counts of aggravated assault resulting in serious bodily injury and one offense of injury to an older adult, were brought against Duntsch in 2015.
He was found guilty in 2017 after the prosecution showed proof of his failed surgeries during his trial. His medical license was suspended, he received a life sentence, and he was required to make reparations to his victims of $155 million.
