Can patients unhappy with their medical care file a malpractice lawsuit?

A specific type of professional negligence is where a medical professional or healthcare facility deviates from the recognized standard of care and causes harm to the patient. It is important to understand that not all adverse outcomes or dissatisfaction with medical care results in malpractice.

Medical Negligence & Medical Malpractice Lawsuits

A malpractice case can only be filed if there is clear evidence of deviation from the standard of care by the healthcare provider and that it directly caused harm to the patient. Also, it’s important to seek legal advice from a medical lawyer to determine if the case has merit and is worth pursuing.

Medical Negligence Case SGH's Misdiagnosis

In 2018, the San Francisco General Hospital came under fire after a patient received an incorrect diagnosis and was forced to undergo surgery that was not necessary.

The patient was taken into surgery for a brain abscess even though there was a possibility that they had a tumor in their brain. It was determined at a later time that the patient did not have a brain abscess but rather a benign tumor that did not need to be operated on.

Because of the incident, a public inquiry was held, and it was determined that the SGH was negligent in providing medical care.
