How does the appeals process work in a medical malpractice case?

A party in a medical malpractice case may ask a higher court to reconsider a lower court’s ruling through the appeals procedure. The appeals procedure often adheres to precise guidelines and deadlines, and it could call for the delivery of legal documents and oral arguments.

Medical Negligence Case Mount Elizabeth Liver Transplant

In 2012, a patient at the Mount Elizabeth Hospital passed away owing to complications that arose following a liver transplant. The deceased’s family alleged that the hospital constituted medical negligence by failing to provide appropriate care for their beloved one and omitting to communicate the risks associated with the operation.

It was asserted that the hospital neglected to perform an adequate evaluation of the patient’s medical history, did not get the patient’s explicit consent, and did not provide appropriate post-operative aftercare. The circumstances surrounding the case led to an inquiry by the government, which established that the hospital had been careless in providing medical services.
