How does the discovery process work in a medical malpractice case?

The discovery phase is a critical stage in the litigation process. It involves the parties exchanging important information and proof. It starts after the case is filed but before the trial begins.

In 2017, medical professionals at the Max Hospital in Delhi, India, pronounced a newborn child deceased. However, the parents discovered that their child was still alive just before they were going to execute the funeral rites.

The hospital was accused of gross negligence, which resulted in the doctors losing their employment. The incident sparked riots, resulting in the Delhi government issuing a directive to investigate the subject.

The investigation concluded that the hospital had committed acts of medical negligence and made the recommendation that its license should be revoked; however, the permit was eventually reinstated by the Delhi High Court.
