By proving that the healthcare worker failed to owe the patient a duty of care, did not breach the quality of care, or that the suffering the patient endured was not led on by the healthcare provider’s wrongful acts or omissions, medical negligence can be contested.
In addition, the defense can claim that the patient’s injuries or illness were brought on by factors other than the health personnel’s conduct, suggesting that the harm would have happened regardless of what the medical professionals did.
One of history’s most notorious instances of unethical medical study is the Tuskegee Syphilis Study. The US Public Health Service conducted the research between 1932 and 1972 intending to determine how syphilis develops naturally in African American men.
The men were not provided with any details regarding their condition or a course of treatment, even after penicillin became a viable option for treating syphilis. Even though the men involved in the research did not receive adequate medical care and suffered greatly as a consequence, the study went on for more than four decades.
When the research was finally made public in the 1970s, it was roundly condemned as an unethical medical experiment that went against the fundamentals of medical ethics.
The Tuskegee study marked a turning point in medical ethics and sparked the creation of rules and standards to ensure that medical research is carried out morally and responsibly.
