The Bolam test is a legal test used in medical negligence cases in the United Kingdom. It establishes that for a healthcare professional to be found negligent, it must be proven that the professional acted in a way that no responsible body of medical practitioners would have done.
This test sets the standard of care against which a professional will be judged and is intended to protect doctors from being held liable for unorthodox treatment decisions.
In 2011, 48-year-old Louis J. Glanville visited the emergency room at Anne Arundel Medical Center in Maryland and reported experiencing nausea, shortness of breath, and chest pains. Despite his ongoing complaints, the doctors who evaluated him gave him an acid reflux diagnosis and sent him home.
Glanville went back to the hospital the following day, but sadly, he had a heart attack and died. His untimely passing shocked his family, who made the decision to sue the hospital and the attending doctor who had seen him. They claimed the doctors had given him subpar care and misdiagnosed and undertreated his cardiac ailment.
After a protracted legal conflict and a trial, the parties eventually came to an undisclosed settlement. Although the settlement’s precise sum was kept confidential, it probably paid for Glanville’s family’s high medical costs as well as other losses brought on by his premature passing.
