Medical negligence is seen as a tort in the framework of medical law, meaning that patients who have suffered at the hands of a healthcare professional may pursue damages in court. It is founded on the idea of “duty of care,” which states that anybody is responsible for taking reasonable precautions to prevent injury to others.
In a medical negligence action, the plaintiff must establish that the medical professional owed the patient a duty of care, broke that duty, and caused the patient harm.
Gosport War Memorial Hospital has a notable medical malpractice case in the UK. Almost 450 hospital patients died from high opioid doses between 1989 and 2000. Gosport’s NHS hospital serviced elderly patients.
After several families complained about hospital care, the case surfaced. In 2013, an independent inquiry determined that the hospital had a culture of prescribing and delivering opioids, with doctors and nurses emphasizing pain relief over drug risks. Opioids were provided to many non-painful individuals at excessive doses.
The inquiry called for greater healthcare supervision and responsibility, notably for prescribing practices. The report advised healthcare providers to be held accountable for patient damage and to report and investigate medical errors more openly.
